Major Encroachment Allegations Rock Ayesha Amina Trust in Bengaluru
Claims of Fake Deed, Illegal Khata, and Trustee Inaction Surface
Bengaluru, August 12, 2025: A serious case of alleged illegal encroachment and fraudulent sale of Waqf property has been brought to light in Bengaluru, with accusations pointing towards the President of Ayesha Amina Trust, certain trustees, and officials of the Bruhat Bengaluru Mahanagara Palike (BBMP).
Dr. Yaseen Shariff, a family member of late Haji Nabi Shariff, has alleged that another family member, Ahmed Shariff—currently serving as the Trust’s President—illegally occupied 525 sq. ft. of Waqf land at No. 5, Sadar Patrappa Road, O.T.C. Road Cross, by creating false documents and colluding with BBMP officials to generate a fake Khata (No. 5/1).
Property History and Alleged Fraudulent Actions
According to Dr. Shariff, the land in question was legally purchased by the Ayesha Amina Trust through a registered sale deed dated October 5, 1972, and has remained under uninterrupted possession for over five decades. The property is registered as Waqf with the Karnataka Board of Waqf under registration number KTW/Reg/07/BNU/1982-83.
In 2004, BBMP approved a building plan for a hostel on the property, and taxes for the site have been consistently paid. However, Dr. Shariff alleges that in March 2023, Ahmed Shariff fraudulently created a “Deed of Declaration” falsely claiming part of the land belonged to his late father, who passed away in 1994. Using this document, a new Khata number was allegedly obtained, leading to the construction of six commercial shops without BBMP approval. These were then sold to another individual.
“The Secretary and Trustees of the Trust remained silent spectators while the President leased out the shops and collected rent for personal gain,” Dr. Shariff claimed.
Gift Deeds and Sale to Third Party
On May 23, 2023, Ahmed Shariff allegedly executed six registered gift deeds, transferring the shops to his wife and daughters—a move Dr. Shariff asserts is illegal under the Waqf Act, which prohibits gifting, selling, or transferring Waqf properties.
Later, on June 20, 2025, the premises were allegedly sold to a third party, identified as Mr. Jaishankar, through a registered sale deed. Dr. Shariff maintains that the transaction is void as Waqf land cannot be sold by an individual or Trust President.
